• No spamming is allowed. You may only send a referral email
(or any copy that contains your affiliate link) to people you know
or people on your opt-in list. If you use a third party email list,
the list must be 100% opt-in! Any unsolicited sending of your link
(for example, sending your link in a unsolicited mass email, spam)
will result in immediate cancellation and forfeit of all commissions
you have earned. Also, your affiliate status will be terminated.
• Referrals must be NEW to XR, LLC sites. If you refer someone
who has already been referred by another affiliate, you will not receive
credit if they purchase.
• Affiliates may not promote any of the XR, LLC banners or links
on sites displaying child pornography, bestiality, hate sites or sites
displaying any other kind of illegal material.
• Only banners designed or approved by XR, LLC may be used to
promote XR, LLC sites.
• Affiliates may only use XR, LLC images and videos to promote
XR, LLC sites. Affiliates may only use images and videos provided
expressly for the affiliate program. All other images on XR, LLC web
sites are not for distribution without explicit permission from XR,
LLC.
• Affiliates may not modify graphic images or any other of our
images, in any way. We reserve all rights in the graphic image and
text, any other images, our trade names and trademarks, and all other
intellectual property rights. eXtreme Restraints copyright photo's and text are prohibited for affiliate use, unless you've received express permission from XR, LLC. Please use our banners provided.
• XR, LLC content may not be used to promote any site not owned
by XR, LLC.
• Affiliates may promote XR, LLC sites on AVS sites on condition
that:

• XR, LLC must be able to track the source of traffic at all
times, and be able to access the pages where our banners are displayed,
even if these pages are protected by a password (such as a member's
section). If the affiliate refuses to cooperate, the affiliate's account
will be terminated, and commissions forfeited.
• You may not promote XR, LLC sites on warez sites, password
sites, or any other non-adult web sites unless you have received prior
authorization from XR, LLC to do so.
• You hereby irrevocably represent and warrant that you do not, and will not, employ any unlawful advertising methods in marketing our products, goods and/or services, including but not limited to spam e-mail, junk fax advertising, and any other method of distributing information which is currently unlawful, or which subsequently becomes unlawful in the future. Your warranty shall survive the execution and expiration of this agreement. You also understand and irrevocably agree that said representation and warranty is a material inducement for XR to enter into any agreement with you, and that XR is relying on your representation and warranty in forming its decision whether or not to enter into any agreement with you. In the event that you breach this warranty, you irrevocably agree to indemnify and hold XR and its officers, directors, shareholders, employees, independent contractors, attorneys and agents harmless from any and all costs, expenses, damages, liabilities, fines and / or penalties (including attorney's fees and costs) resulting from said breach(s).
• Credit card fraud is closely monitored and will not be tolerated.
Every case is reported to the credit card companies and to the appropriate
authorities. In the event that any sort of mechanism to falsely generate
sales is detected, we will prosecute the responsible affiliate to
the full extent of the law, and, of course, the affiliate's account
will be terminated and commissions forfeited.
• XR, LLC is not responsible for loss due to downtime resulting
from complications with hosting equipment, hardware, or technical
errors.
• The affiliate is responsible for providing XR, LLC with a valid
e-mail address to be used for contact purposes.
• In the event that any conditions need to be changed, or new
conditions added, XR, LLC will post a notice on this page and will
send out an email to all affiliates. Affiliates will have seven (7)
days to become fully compliant with the new conditions. Affiliates
not respecting the new conditions will have their accounts terminated,
and commissions generated after the new conditions become applicable
will be forfeited.
• XR, LLC reserves the right to terminate this agreement or program
at any time, for any reason. In any case, Affiliates will be notified
and will be paid for all earnings generated up to that point in time,
except in cases where it is determined that the affiliate has cheated
by violating these terms and conditions.
